1. Eligibility & Permission

I certify that I am at least 18 years old and either:

• the homeowner of the property being entered, or

• I have full permission from the homeowner or property owner to register the home, place a sign in the yard, and have the address and photo displayed publicly.

Christmas Joyride may verify eligibility and may decline or remove entries that provide false, incomplete, or unverifiable information.

2. Communications Consent (TCPA Notice)

I consent to receive communications from participating real estate agents and their partners, including automated and manual text messages, phone calls, emails, and event updates.

I understand:

• Consent is not required to participate.

• I may opt out at any time.

• Standard message and data rates may apply.

• Real estate agents are independently responsible for complying with TCPA and all communication laws.

• If any agent violates these laws, I agree Christmas Joyride, its creators, hosts, partners, sponsors, affiliates, and organizers are not liable for those violations.

I also consent to receive occasional notifications about future Christmas Joyride events or holiday contests, with the ability to opt out anytime.

3. Sign Placement Permission

I grant permission for a Christmas Joyride yard sign to be placed in my yard for the duration of the contest. The sign may include branding for participating real estate agents, partners, sponsors, and voting QR codes.

4. Public Display of Address, Photos & Home Information

I consent to the public display of:

• my home address

• the images or videos I upload

• descriptions or details I submit

These may appear on:

• the event website

• maps and voting pages

• social media

• recap videos

• future promotional materials

• printed or digital materials related to Christmas Joyride

I understand that participating makes my home publicly visible and that members of the public may drive by my home.

5. Photo Rights & Copyright Certification

I certify that the photos or content I upload:

• are my original work or I have full rights to use them

• do not infringe on copyright or intellectual property rights

I grant Christmas Joyride and all partners a royalty-free, worldwide, perpetual license to use my photos, videos, or content for:

• marketing

• advertising

• social media

• future year promotions

• recap videos

• highlight reels

• event materials

6. Public Participation, Safety, & Hold Harmless

I acknowledge that this event encourages members of the public to view participating homes. I understand and agree that:

• Christmas Joyride, its creators, organizers, hosts, partners, sponsors, affiliates, and real estate agents are not responsible for any injury, accident, trespassing, property damage, or harm caused by individuals driving or walking near my home.

• I assume all risks associated with increased traffic, public visibility, and participation in a community event.

• I agree to hold harmless and release Christmas Joyride and all related parties from any liability related to the event.

7. Indemnification

I agree to indemnify, defend, and hold harmless Christmas Joyride, its creators, hosts, organizers, partners, agents, sponsors, and affiliates from any claims, damages, lawsuits, losses, or legal fees arising from:

• my participation

• my submitted content

• injuries or damages occurring in connection with my property

• violations of law or regulations

• agent behavior outside of Christmas Joyride’s control

8. Safety Requirements

I agree to ensure that my decorations and lighting:

• are secure and safe

• do not block sidewalks or streets

• follow basic electrical and fire safety guidelines

Christmas Joyride is not responsible for any injuries related to the decorations themselves.

9. Voting Integrity & Conduct

I agree not to engage in:

• vote manipulation

• fraudulent entries

• harassment of other participants

• abusive behavior toward organizers or partners

Christmas Joyride may remove or disqualify any participant for inappropriate conduct.

10. Contest Rules & Prize Disclaimer

I understand:

• Participation does not guarantee placement, listing position, or winning.

• Voting is public and may not be fully accurate, free from errors, or immune to technical issues.

• Christmas Joyride may adjust categories, modify rules, disqualify entries, or cancel the event at its discretion.

• Winners may be required to verify eligibility.

• Prizes are non-transferable and may be subject to taxes.

• No cash alternative is offered unless explicitly stated.

11. No Guarantees or Warranties

Christmas Joyride does not guarantee:

• website uptime

• continuous voting access

• mapping accuracy

• display of submissions without interruption

• traffic to my home

• error-free experiences

12. Event Modification or Cancellation

I understand that Christmas Joyride may modify, suspend, or cancel the event or portions of it due to:

• weather

• safety concerns

• technical failures

• unforeseen circumstances

13. Removal or Withdrawal of Entries

I may request removal from the contest at any time, and Christmas Joyride will remove my information as quickly as reasonably possible.
Christmas Joyride may also remove entries at its discretion for any reason, including but not limited to:

• safety issues

• inappropriate or offensive displays

• violations of the agreement

• community complaints

• suspected fraud

14. Privacy & Data Use

I understand that:

• My information is used for event communication, voting, and participation management.

• My information may be shared with participating agents and partners only for event-related communication.

15. Limitation of Liability

To the fullest extent permitted by law, I agree that the maximum liability of Christmas Joyride and all associated parties for any claim shall not exceed $100.

16. Governing Law

This agreement is governed by and interpreted according to the laws of the State of Missouri.

17. Arbitration & Dispute Resolution

Any dispute arising from participation in the Christmas Joyride shall be resolved exclusively through binding arbitration, and not in court.
I waive the right to participate in any class-action lawsuit or class-wide arbitration.

18. Severability

If any part of this agreement is found unenforceable, the remaining provisions shall remain in full force and effect.

19. Full Liability Release

By participating, I voluntarily assume all risks associated with the Christmas Joyride and release Christmas Joyride, its creators, organizers, hosts, partners, sponsors, real estate agents, affiliates, and volunteers from any and all liability, claims, damages, or losses arising from my participation.
